8.—(1) The Individual Learning Account (Scotland) Regulations 2004(1) shall be amended as follows.
(2) In regulation 1(2)–
(a)at the end of the definition of “Scheme” for “Regulations.” substitute “Regulations; and”; and
(b)after that definition insert–
““Switzerland Agreement” means the Agreement between the European Community and its member States, of the one part, and the Swiss Confederation, of the other, on the Free Movement of Persons signed at Luxembourg on 21st June 1999(2) and which came into force on 1st June 2002.”.
(3) In regulation 3(4)–
(a)at the end of sub-paragraph (e) for “Area.” substitute “Area; or”; and
(b)after sub-paragraph (e) insert–
“(f)is a person not falling within paragraphs (a) to (d) but is a national of Switzerland and who is entitled to become a learning account holder by virtue of Article 3(6) or of Article 9(3) of Annex I to the Switzerland Agreement.”.
