The Common Agricultural Policy (Wine) (Scotland) Amendment Regulations 2004

The Scottish Ministers, in exercise of the powers conferred by section 2(2) of the European Communities Act 1972(1) and all other powers enabling them in that behalf, hereby make the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Common Agricultural Policy (Wine) (Scotland) Amendment Regulations 2004, and shall come into force on 5th July 2004.

Amendment of the principal Regulations

2.  The Common Agricultural Policy (Wine) (Scotland) Regulations 2002(2) are amended in accordance with regulations 3 to 8.

3.  In regulation 2(1) (interpretation)–

(a)for the definition of “Community provision” substitute–

“Community provision” means any provision of the Regulations and Decisions of the European Communities which are listed in Schedule 6 including any amendments made to any of those provisions by the Act concerning the conditions of accession of the Czech Republic, the Republic of Estonia, the Republic of Cyprus, the Republic of Latvia, the Republic of Lithuania, the Republic of Hungary, the Republic of Malta, the Republic of Poland, the Republic of Slovenia and the Slovak Republic and the adjustments to the Treaties on which the European Union is founded(3) signed on 16th April 2003;; and

(b)omit the following definitions:–

(i)“Commission Regulation 3388/81”;

(ii)“Commission Regulation 3201/90”;

(iii)“Commission Regulation 554/95”.

4.  In regulation 8 (control on movement)–

(a)in paragraph (2) for “either in writing or in electronic form” substitute “in writing”; and

(b)in paragraph 2(b) for “which may be given in writing or in electronic form” substitute “in writing”.

5.  Schedule 1 is omitted.

6.  Schedule 3 is omitted.

7.  For Schedule 6 substitute the Schedule set out in Schedule 1 to these Regulations.

8.  For items 1 and 2 of the table set out in Part II of Schedule 9 substitute the items set out in Schedule 2 to these Regulations.

Explanatory Note

(This note is not part of the Regulations)

These Regulations further amend the Common Agricultural Policy (Wine) (Scotland) Regulations 2002 as amended (“the principal Regulations”), which provide for the enforcement of European Community Regulations concerned with the production and marketing of wine and related products.

These Regulations amend the principal Regulations–

(a)by amending the definition of “community provision” to take account of EU enlargement and deleting certain definitions which are now obsolete due to the repeal of the community provisions in question (regulations 3, 5 and 6);

(b)by removing the right of an authorised officer to serve a movement control notice or consent to the movement of wine sector products in relation to which such notice has been served in electronic form (regulation 4);

(c)by updating references to European Community legislation by substituting a new Schedule 6 to the principal Regulations and updating Part II of Schedule 9 (regulations 7 and 8.)

No Regulatory Impact Assessment has been prepared in respect of these Regulations.
