The Scottish Ministers, in exercise of the powers conferred by section 40 of and Schedule 5 to the Local Government etc. (Scotland) Act 1994(1), and of all other powers enabling them in that behalf, having consulted such persons or bodies as they think fit in accordance with section 40(6) of that Act, hereby make the following Order:

Citation and commencement

1.  This Order may be cited as the Strathclyde Passenger Transport Authority (Constitution, Membership and Transitional and Consequential Provisions) Amendment Order 2003 and shall come into force on 2nd April 2003.

Amendment of the 1995 Order

2.  In article 12(1) of The Strathclyde Passenger Transport Authority (Constitution, Membership and Transitional and Consequential Provisions) Order 1995(2) for “or to the chairman” there is substituted “, to the chairman or to an officer or member of staff”.

Explanatory Note

(This note is not part of the Order)

This Order amends article 12 of the Strathclyde Passenger Transport Authority (Constitution, Membership and Transitional and Consequential Provisions) Order 1995 to enable Strathclyde Passenger Transport Authority to delegate its functions to officers or members of staff.

1994 c. 39; Schedule 5, paragraph 7 was amended by section 48 of the Local Government in Scotland Act 2003 (asp 1). The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46).
