The Scottish Ministers, in exercise of the powers conferred by sections 1(1) and (2) and 24(3) of the Food and Environment Protection Act 1985(1) and of all other powers enabling them in that behalf, hereby make the following Order:

Citation and commencement

1.  This Order may be cited as the Food Protection (Emergency Prohibitions) (Amnesic Shellfish Poisoning) (West Coast) (Scotland) Partial Revocation (No. 2) Order 2001 and shall come into force at 1700 hours on 7th November 2001.

Revocation

2.  The Food Protection (Emergency Prohibitions) (Amnesic Shellfish Poisoning) (West Coast) (Scotland) Order 2001(2) is hereby revoked in so far as it designates any part of the area set out in the Schedule to this Order being an area within the area described in the Schedule to that Order.

Article 2

SCHEDULE

The area of sea below mean high water springs enclosed by a line starting on the west coast of the Mull of Kintyre at 56°North latitude 5°40.5'West longitude; then west to a point on the east coast of Jura at 56°North latitude 5°48'West longitude; then south along the shoreline to 55°47.8'North latitude 6°West longitude; then south to 55°45'North latitude 6°West longitude; then east to a point on the west coast of the Mull of Kintyre at 55°45'North latitude 5°35'West longitude; then north along the shoreline to the point of beginning.

Explanatory Note

(This note is not part of the Order)

This Order is the second partial revocation of the Food Protection (Emergency Prohibitions) (Amnesic Shellfish Poisoning) (West Coast) (Scotland) Order 2001 (“the principal Order”) which prohibited–

(a)fishing for or taking scallops within the area designated in the Schedule to that Order (article 4 of the principal Order);

(b)movement of such scallops out of that area (article 5 of the principal Order); and

(c)landing, using in the preparation or processing for supply of food of, supplying and other specified activities in relation to, such scallops from the designated area (article 6 of the principal Order).

The effect of this Order is to remove the prohibitions in respect of the area of sea designated in the Schedule to this Order which forms part of the area of sea designated in the Schedule to the principal Order.
