The Scottish Ministers, in exercise of the powers conferred by sections 73(f), 73B and 74(1) of the Education (Scotland) Act 1980(1) and of all other powers enabling them in that behalf, hereby make the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Education (Student Loans) (Scotland) Regulations 2000 Amendment (No. 2) Regulations 2001 and shall come into force on 4th October 2001.

Amendment of the Education (Student Loans) (Scotland) Regulations 2000

2.  The Education (Student Loans) (Scotland) Regulations 2000(2) are amended as follows.

3.  In regulation 5–

(a)in paragraph (2), for the figure “19” substitute the figure “18”; and

(b)after paragraph (2), insert the following paragraph:–

(2A) For the purposes of paragraph (2), where periods of both full-time study and work experience occur within any week of the course, the days of full-time study shall be aggregated with any weeks of full-time study in determining the number of weeks of full-time study in each year..

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Education (Student Loans) (Scotland) Regulations 2000 (“the principal Regulations”). Regulation 5(2) of the principal Regulations is amended so that a sandwich course is a designated course for the purposes of regulation 4(2) of those Regulations if a student undertaking that course is required to attend periods of full-time study for an average of at least 18 (instead of 19) weeks in each year (regulation 3(a)). Only students undertaking designated courses are eligible for student loans.

A new paragraph is inserted in regulation 5 of the principal Regulations to provide that where periods of full-time study and work experience occur within any week of a sandwich course, the days of full-time study shall be aggregated with any weeks of full-time study in determining the number of weeks of full-time study in each year (regulation 3(b)).

Section 73B was inserted by the Teaching and Higher Education Act 1998, section 29(2), and was amended by the Education (Graduate Endowment and Student Support) (Scotland) Act 2001, section 3(3). Section 74 was amended by the Self-Governing Schools etc. (Scotland) Act 1989 (c. 39) Schedule 10, paragraph 8(17). The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46).
