The Scottish Ministers, in exercise of the powers conferred by article 17(1) of the Foot-and-Mouth Disease Order 1983(1) and of all other powers enabling them in that behalf, hereby make the following Order:

Citation and commencement

1.  This Order may be cited as the Foot-and-Mouth Disease (Scotland) Declaratory (No. 5) Amendment (No. 6) Order 2001 and shall come into force at 5.00 p.m. on 27th July 2001.

Amendment of infected area

2.  For Schedule 1 of the Foot-and-Mouth Disease (Scotland) Declaratory (No. 5) Order 2001(2), there is substituted the Schedule 1 set out in the Schedule to this Order.

Revocation

3.  The Foot-and-Mouth Disease (Scotland) Declaratory (No. 5) Amendment (No. 5) Order 2001(3) is revoked.

SCHEDULESCHEDULE 1 AS SUBSTITUTED BY THIS ORDER

Article 2

SCHEDULE 1

The infected area shall comprise those parts of the Dumfries and Galloway council area, within the following boundaries:–

(a)from the sea at map ref NY040620, follow the coastline north east to a point at map ref NY090667; from that point follow the course of Thwaite Burn north east to where it is crossed by a minor road at map ref NY096674; turn right onto the minor road and continue east to its junction with another minor road at map ref NY105674; turn left onto the minor road and continue north to its junction with the B724; turn right onto the B724 and continue east to where it crosses Pow Water; turn left and follow the course of Pow Water to where it is crossed by a minor road at map ref NY111686;

(b)turn right onto the minor road and continue east to where it crosses Glen Burn at map ref NY122688; turn left and follow the course of Glen Burn to where it is crossed by the A75(T); turn left onto the A75(T) and continue north west to its junction with a minor road at map ref NY123706; turn right onto the minor road and continue north east to its junction with the B7020; turn right onto the B7020 and continue south east to its junction with a minor road at map ref NY133713; turn left onto the minor road and continue east to its junction with another minor road map ref NY156714;

(c)turn left onto the minor road and continue north to its junction with the B725; turn right onto the B725 and continue east then north to where it crosses the River Annan; turn right and follow the course of the River Annan east to where it meets Mein Water at map ref NY184724; turn left and follow the course of Mein Water north to where it is crossed by a minor road at map ref NY185728; turn right onto this minor road and continue south to its junction with another minor road at map ref NY193713; turn left onto this minor road and continue north east to its junction with the B722;

(d)continue across the B722 onto a track; follow the track north east to where it meets the A74(M); turn right onto the A74(M) and continue south east to where it crosses Kirtle Water; turn left and follow the course of Kirtle Water north to where it is crossed by a minor road at map ref NY248748; turn left onto the minor road and continue west to its junction with the B722; turn right onto the B722 and continue north to its junction with a track at map ref NY244763; turn right and follow the track south east to where it meets Kirtle Water at map ref NY248762; turn left and follow the course of Kirtle Water north to where it is crossed by a minor road at map ref NY251774;

(e)turn left onto the minor road and continue north to its junction with the B722; turn right onto the B722 and continue north east to its junction with the B7068; turn left onto the B7068 and continue north west to its junction with a minor road at map ref NY230834; turn right onto this minor road, then right again onto another minor road and continue north to its junction with another minor road at map ref NY258906; turn right onto this minor road and continue north east then east to its junction with the B709; turn right onto the B709 and continue south east to its junction with the A7(T); turn left onto the A7(T) and continue north to its junction with a minor road at map ref NY366854;

(f)turn right onto the minor road and continue north east to its junction with another minor road at map ref NY403871; turn right onto the minor road and continue east until it meets the border between the Scottish Borders and Dumfries and Galloway council areas at Loch Knowe at map ref NY426872; follow the border between the Scottish Borders and Dumfries and Galloway council areas south until it meets the England/Scotland border at map ref NY453797; turn right onto the England/Scotland border and follow it until it meets the sea at map ref NY040620.

Map references are to the Ordnance Survey Landranger 1:50,000 series.

Explanatory Note

(This note is not part of the Order)

This Order further reduces the infected area declared by the Foot-and-Mouth Disease (Scotland) Declaratory (No. 5) Order 2001 and subject to the restrictions therein.

A map depicting the infected area may be inspected between 9.00 a.m. and 5.00 p.m., Monday to Friday at the Scottish Executive Rural Affairs Department, Pentland House, 47 Robb’s Loan, Edinburgh EH14 1TW.
