The Scottish Ministers, in exercise of the powers conferred by article 17(1) of the Foot-and-Mouth Disease Order 1983(1) and of all other powers enabling them in that behalf, hereby make the following Order:

Citation and commencement

1.  This Order may be cited as the Foot-and-Mouth Disease (Scotland) Declaratory (No. 5) Amendment (No. 5) Order 2001 and shall come into force at 5.00 p.m. on 20th July 2001.

Amendment of infected area

2.  For Schedule 1 of the Foot-and-Mouth Disease (Scotland) Declaratory (No. 5) Order 2001(2), there is substituted the Schedule 1 set out in the Schedule to this Order.

Revocation

3.  The Foot-and-Mouth Disease (Scotland) Declaratory (No. 5) Amendment (No. 4) Order 2001(3) is revoked.

The infected area shall comprise those parts of the Dumfries and Galloway council area, within the following boundaries:–

(a)from the coast at map ref NY153633 continue west along the coastline to map ref NX989636 at Burnfoot; follow the minor road west to its junction with the A710; turn right onto the A710 and continue north to its junction with a minor road at map ref NX963687; turn left onto the minor road and continue west to its junction with another minor road at Glensone at map ref NX915677; turn right onto this minor road and continue north west to its junction with the A711;

(b)turn right onto the A711 and continue north east to its junction with a minor road at map ref NX916717; turn left onto the minor road and continue north to its junction with the A75(T); turn right onto the A75(T) and continue to its junction with a minor road at map ref NX905748; turn left onto the minor road and continue north to its junction with another minor road at map ref NX909769; turn right onto this minor road and continue north east to its junction with another minor road at map ref NX921778; turn left onto this minor road and continue north to its junction with another minor road at map ref NX916795; turn right onto this minor road and continue to its junction with another minor road at map reference NX917795; turn left onto this minor road and continue north east to its junction with the A76(T);

(c)turn left onto the A76(T) and continue north west to its junction with a minor road at map ref NX913865; turn right onto this minor road and continue south east to Dalswinton at map ref NX937855; from Dalswinton continue in a straight line in a north-easterly direction to Shaw’s Hill at map ref NX947867; from Shaw’s Hill continue in a straight line in a north-easterly direction to Ae at map ref NX983894; from Ae continue in a straight line in a north-easterly direction to Pumro Fell at map ref NY019923; from Pumro Fell continue in a straight line in an easterly direction to the junction of the A701(T) and a minor road at map ref NY069933; from this junction follow the minor road south east to its junction with another minor road at map ref NY080918; turn left onto this minor road and continue east to its junction with the B7076; turn right onto the B7076 and continue south until it meets a minor road at map ref NY103914; turn left onto the minor road and continue east to its junction with another minor road at map ref NY107915; turn left onto this minor road and continue north east to its junction with another minor road at Wamphraygate;

(d)turn right onto the minor road and continue north east until it meets a track at Laverhay at map ref NY141980; turn right onto the track and continue until it meets Milne Height at map ref NY154975; from Milne Height continue in a straight line to Three Mullach Hill at map ref NY168972; from Three Mullach Hill continue in a straight line to Cairn Knowe at map ref NY195971; from Cairn Knowe continue in a straight line in a south-easterly direction to Kilburn Hill at map ref NY211965; from Kilburn Hill continue in a straight line in a south-easterly direction to where the B723 crosses the Black Burn at map ref NY236961;

(e)turn left onto the B723 and continue to its junction with the B709; turn right onto the B709 and continue to Billholm at map ref NY279920; from that point follow the Billholm burn north to map ref NY279923; turn right and follow the forest boundary until it meets the Shiel Burn at map ref NY285925; from that point follow the Shiel Burn south until it meets a minor road at map ref NY289917; turn left onto the minor road and continue east and south east past Westerkirk Mains until it meets another minor road at map ref NY296916; from this junction continue in a straight line in an easterly direction to Crumpton Hill at map ref NY347914; from Crumpton Hill continue in a straight line in an easterly direction to Watch Hill at map ref NY436908 on the border between the Scottish Borders and Dumfries and Galloway council areas; follow the border between the Scottish Borders and Dumfries and Galloway Council areas south until it meets the England/Scotland Border at map reference NY453797; turn right onto the England/Scotland Border and follow it until it meets the sea at map reference NY153633.

Map references are to the Ordnance Survey Landranger 1:50,000 series.

Explanatory Note

(This note is not part of the Order)

This Order further reduces the infected area declared by the Foot-and-Mouth Disease (Scotland) Declaratory (No. 5) Order 2001 and subject to the restrictions therein.

A map depicting the infected area may be inspected between 9.00 a.m. and 5.00 p.m., Monday to Friday at the Scottish Executive Rural Affairs Department, Pentland House, 47 Robb’s Loan, Edinburgh EH14 1TW.
