The Foot-and-Mouth Disease (Amendment) (No. 3) (Scotland) Order 2001

The Scottish Ministers, in exercise of the powers conferred by sections 1, 2, 8 and 23(b) of the Animal Health Act 1981(1), and of all other powers enabling them in that behalf, hereby make the following Order:

Citation, commencement and extent

1.—(1) This Order may be cited as the Foot-and-Mouth Disease (Amendment) (No. 3) (Scotland) Order 2001 and shall come into force at 6.00 p.m. on 14th March 2001.

(2) This Order extends to Scotland only.

Amendment of the Foot-and-Mouth Disease Order 1983

2.—(1) The Foot-and-Mouth Disease Order 1983(2) is amended in accordance with the following paragraphs of this article.

(2) In paragraph (1) of article 3 (interpretation), after the definition of “suspected animal” there shall be inserted the following definition–

(3) For paragraph (1)(a) of article 8 (restrictions to operate immediately on certification of suspected case of disease) there is substituted–

(a)the movement is through the area by motorway, trunk road or railway and the animal is not unloaded within the area;.

(4) In paragraph (3) of article 35B (declaration of a prohibited area)(4) for the words “a declaration” there is substituted the word “regulations”.

Explanatory Note

(This note is not part of the Order)

This Order, which extends to Scotland only, amends the Foot-and-Mouth Disease Order 1983 to allow animals to be moved through areas where disease is suspected, notwithstanding that the area is under the restrictions of a Form C Notice, provided such movement is by motorway, trunk road or rail and that the animals are not unloaded in the area under restriction.
