Coming into force in accordance with article 1

The Scottish Ministers, in exercise of the powers conferred by section 1(1) and (2) and section 24(3) of the Food and Environment Protection Act 19851, and of all other powers enabling them in that behalf, hereby make the following Order:

Citation and commencement1

This Order may be cited as the Food Protection (Emergency Prohibitions) (Amnesic Shellfish Poisoning) (West Coast) (No. 3) (Scotland) Partial Revocation Order 2000 and shall come into force at 1700 hours on 19th October 2000.

Interpretation2

In this Order “the principal Order” means the Food Protection (Emergency Prohibitions) (Amnesic Shellfish Poisoning) (West Coast) (No. 3) (Scotland) Order 20002.

Partial Revocation of the principal Order3

The principal Order is revoked insofar as it designates any part–

a

of Area 1 and Area 3 described in the Schedule to the principal Order; and

b

the area described in the Schedule to this Order being an area within Area 2 described in the Schedule to the principal Order.

SCHEDULE

Article 3

The area of sea below mean high water springs enclosed by a line starting on the north east coast of Lewis at 58°30' North latitude 6°13.2' West longitude; then east to 58°30' North latitude 6° West longitude; then south to 58° North latitude 6° West longitude; then west to Srianach at 58° North latitude 6°23' West longitude; then north along the shoreline of Lewis to the point of beginning.

This Order is the first partial revocation of the Food Protection (Emergency Prohibitions) (Amnesic Shellfish Poisoning) (West Coast) (No. 3) (Scotland) Order 2000 (S.S.I. 2000/303) (“the principal Order”) which prohibited–

a

fishing for or taking scallops within the areas designated in the Schedule to that Order (article 4 of the principal Order);

b

movement of such scallops out of these areas (article 5 of the principal Order); and

c

landing, using in the preparation or processing for supply of food of, supplying and other specified activities in relation to, such scallops from the designated areas (article 6 of the principal Order).

The effect of this Order is to remove the prohibitions in respect of Areas 1 and 3 designated in the Schedule to the principal Order and in respect of the area of sea designated in the Schedule to this Order, which forms part of the area of sea designated as Area 2 in the Schedule to the principal Order.
