The Scottish Ministers, in exercise of the powers conferred upon them by sections 12A(1) and (4) and 105(6) of, and paragraphs 1 and 3(1)(b) of Schedule 7A to, the National Health Service (Scotland) Act 1978(1) and of all other powers enabling them in that behalf, hereby make the following Order:

1978 c. 29; section 12A(1) and (4) was inserted by the National Health Service and Community Care Act 1990 (c. 19) (“the 1990 Act”), section 31 and amended by the Health Act 1999 (c. 8) (“the 1999 Act”), section 46; Schedule 7A was inserted by the 1990 Act, Schedule 6 and was amended by the 1999 Act, Schedule 4, paragraph 62. The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46).
