The Scottish Ministers, in exercise of the powers conferred on them by section 1(1) and (2) and section 24(3) of the Food and Environment Protection Act 1985(1), and of all other powers enabling them in that behalf, hereby make the following Order:

Citation and commencement

1.  This Order may be cited as the Food Protection (Emergency Prohibitions) (Paralytic Shellfish Poisoning) (Orkney) (No. 3) (Scotland) Partial Revocation Order 2000 and shall come into force at 1700 hours on 12th September 2000.

Interpretation

2.  In this Order “the principal Order” means the Food Protection (Emergency Prohibitions) (Paralytic Shellfish Poisoning) (Orkney) (No. 3) (Scotland) Order 2000(2).

Partial Revocation of the principal Order

3.  The principal Order is revoked insofar as it designates any part of the area described in the Schedule to this Order being an area within the area described in the Schedule to the principal Order.

SCHEDULE

The area of sea below mean high water springs enclosed by a line starting on the Orkney mainland at 59°00.5'North latitude 3°West longitude; then north to the south coast of Rousay at 59°07.5'North latitude 3°West longitude; then east, north and west along the shoreline of Rousay to a point on the north shore at 59°10.7'North latitude 3°West longitude; then north to 59°15'North latitude 3°West longitude; then east to a point on the west coast of Westray at 59°15'North latitude 2°52.5'West longitude; then south, east and north along the shoreline to a point on the east coast of Westray at 59°15'North latitude 2°50.1'West longitude; then east to a point on the west coast of Sanday at 59°15'North latitude 2°38.3'West longitude; then south, east and north along the shore of Sanday to a point on the east coast of Sanday at 59°15.4'North latitude 2°30'West longitude; then south to 59°North latitude 2°30'West longitude; then west to the bay of Meil on the Orkney mainland at 59°North latitude 2°54.4'West longitude; then west and north along the shore to the point of beginning.

Explanatory Note

(This note is not part of the Order)

This Order is the first partial revocation of the Food Protection (Emergency Prohibitions) (Paralytic Shellfish Poisoning) (Orkney) (No. 3) (Scotland) Order 2000 (S.S.I. 2000/266) (“the principal Order”) which prohibited–

(a)fishing for or taking scallops within the area designated in the Schedule to that Order (article 4 of the principal Order);

(b)movement of such scallops out of that area (article 5 of the principal Order); and

(c)landing, using in the preparation or processing for supply of food of, supplying and other specified activities in relation to, such scallops from the designated area (article 6 of the principal Order).

The effect of this Order is to remove the prohibitions in respect of the area of sea designated in the Schedule to this Order, which forms part of the area of sea designated in the Schedule to the principal Order.
