The Scottish Ministers, in exercise of the powers conferred on them by section 1(1) and (2) and section 24(3) of the Food and Environment Protection Act 1985(1), and of all other powers enabling them in that behalf, hereby make the following Order:

Citation and commencement

1.  This Order may be cited as the Food Protection (Emergency Prohibitions) (Amnesic Shellfish Poisoning) (West Coast) (No. 2) (Scotland) Partial Revocation Order 2000 and shall come into force at 1200 hours on 12th September 2000.

Interpretation

2.  In this Order “the principal Order” means the Food Protection (Emergency Prohibitions) (Amnesic Shellfish Poisoning) (West Coast) (No. 2) (Scotland) Order 2000(2).

Partial Revocation of the principal Order

3.  The principal Order is revoked insofar as it designates any part of the area described in the Schedule to this Order being an area within Area 3 described in the Schedule to the principal Order.

Article 3

SCHEDULE

The area of sea enclosed by a line starting from a point at 55°30'North latitude 6°30'West longitude; then east to 55°30'North latitude 6° West longitude; then south to the point where the 6° West line of longitude meets the Scottish Adjacent Waters boundary line described in article 3(b) of the Scottish Adjacent Waters Boundaries Order 1999(3); then north and west along that boundary line to the point where that boundary line meets the 6°30'West line of longitude; then north to the point of beginning.

Explanatory Note

(This note is not part of the Order)

This Order is the first partial revocation of the Food Protection (Emergency Prohibitions) (Amnesic Shellfish Poisoning) (West Coast) (No. 2) (Scotland) Order 2000 (S.S.I. 2000/291) (“the principal Order”) which prohibited–

(a)fishing for or taking scallops within the areas designated in the Schedule to that Order (article 4 of the principal Order);

(b)movement of such scallops out of these areas (article 5 of the principal Order); and

(c)landing, using in the preparation or processing for supply of food of, supplying and other specified activities in relation to, such scallops from the designated areas (article 6 of the principal Order).

The effect of this Order is to remove the prohibitions in respect of the area of sea designated in the Schedule to this Order, which forms part of the area of sea designated as Area 3 in the Schedule to the principal Order.
