The Scottish Ministers, in exercise of the powers conferred on them by sections 17(2) and 48(1) of the Food Safety Act 1990(1) and of all other powers enabling them in that behalf, having regard in accordance with section 48(4A) of that Act(2) to relevant advice given by the Food Standards Agency, hereby make the following Regulations:

Citation, commencement and extent

1.  These Regulations may be cited as the Tetrachloroethylene in Olive Oil (Scotland) Revocation Regulations 2000 and shall come into force on 30th September 2000.

2.  These Regulations extend to Scotland only.

Revocation and amendment

2.—(1) The Tetrachloroethylene in Olive Oil (Scotland) Regulations 1989(3) are hereby revoked.

(2) The Food Safety Act (Consequential Modifications) (Scotland) Order 1990(4) is amended by removing any reference to the Tetrachloroethylene in Olive Oil (Scotland) Regulations 1989 from:

(a)Part I of Schedule 1;

(b)Part II of Schedule 3;

(c)Schedule 4; and

(d)Schedule 8.

Explanatory Note

(This note is not part of the Regulations)

These Regulations, which apply only to Scotland;

  • revoke the Tetrachloroethylene in Olive Oil (Scotland) Regulations 1989, as amended which applied in Scotland; and

  • amend the Food Safety Act (Consequential Modifications) (Scotland) Order 1990 by removing the references to the Tetrachloroethylene in Olive Oil Regulations 1989.

The Tetrachloroethylene in Olive Oil Regulations 1989 made provision for the enforcement of Article 1 of Commission Regulation (EEC) No. 1860/88 on the establishment of special marketing standards for olive oil (O.J. No. L 166, 1.7.88, p.16). That Commission Regulation has now been revoked by Commission Regulation (EEC) No. 3009/91 (O.J. L 286, 16.10.91, p.19) and replaced by Commission Regulation (EEC) No. 2568/91 (O.J. No. L 248, 5.9.91, p.1) enforcement of which is provided for in the Olive Oil Marketing Standards (Amendment) Regulations 1992 (S.I. 1992/2590).


1990 c. 16; section 17(2) was amended by the Food Standards Act 1999 (c. 28), Schedule 5, paragraphs 8 and 12; section 48(1) was amended by paragraph 8 of that Schedule. The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46).


Section 48(4A) was inserted by paragraph 21 of Schedule 5 to the Food Standards Act 1999.
