The Scottish Ministers, in exercise of the powers conferred on them by section 1(1) and (2) of the Food and Environment Protection Act 19851, and of all other powers enabling them in that behalf, hereby make the following Order:

Citation and commencement1

This Order may be cited as the Food Protection (Emergency Prohibitions) (Amnesic Shellfish Poisoning) (Orkney) (No. 2) (Scotland) Revocation Order 2000 and shall come into force at 15.00 hours on 20th April 2000.

Revocation2

The Food Protection (Emergency Prohibitions) (Amnesic Shellfish Poisoning) (Orkney) (No. 2) (Scotland) Order 19992 is revoked.

This Order revokes the Food Protection (Emergency Prohibitions) (Amnesic Shellfish Poisoning) (Orkney) (No. 2) (Scotland) Order 1999 (“the principal Order”) which prohibited–

a

fishing for or taking of scallops of the class pecten maximus and Queen scallops of the class chlamys opercubis within the area designated in the Schedule to that Order (article 3);

b

movement of such scallops out of that area (article 5); and

c

landing, using in the preparation or processing for supply of food of, supplying and other specified activities in relation to, such scallops from the designated area (article 6).

The principal Order was partially revoked insofar as it related to Queen scallops by the Food Protection (Emergency Prohibitions) (Amnesic Shellfish Poisoning) (Orkney) (No. 2) (Scotland) Partial Revocation Order 1999 (S.S.I. 1999/160).

The effect of this Order is to remove the remaining prohibitions in respect of scallops of the class pecten maximus in the area of sea designated in the Schedule to the principal Order.
