The National Health Service Trusts (Originating Capital) (Scotland) Order 2000

The Scottish Ministers, in exercise of the powers conferred upon them by sections 12E(1) of the National Health Service (Scotland) Act 1978(1) and of all other powers enabling them in that behalf, hereby make the following Order:

Citation and commencement

1.  This Order may be cited as the National Health Service Trusts (Originating Capital) (Scotland) Order 2000 and shall come into force on 17th April 2000.

Originating capital of NHS trusts

2.  The originating capital of an NHS trust specified in column 1 of the Schedule to this Order shall be of the amount specified opposite it in column 2 of that Schedule.

Revocation

3.  The National Health Service Trusts (Originating Capital Debt) Order 1993(2); The National Health Service Trusts (Originating Capital Debt) (Scotland) Order 1994(3); The National Health Service Trusts (Originating Capital Debt) (Scotland) Order 1995(4) and The National Health Service Trusts (Originating Capital Debt) (Scotland) Order 1996(5) are hereby revoked.

Explanatory Note

(This note is not part of the Order)

This Order determines the amount of the originating capital provided for in section 12E of the National Health Service (Scotland) Act 1978 (c. 29) as amended by section 53 of the Health Act 1999 (c. 8). This Order applies to these NHS trusts established under the National Health Service (Scotland) Act 1978 with an operational date of 1st April 1999 or, in the case of Yorkhill NHS Trust, 1st April 1993, Dumfries and Galloway Acute and Maternity Hospitals NHS Trust, 1st April 1994 and Borders General Hospitals NHS Trust, 1st April 1995. The Order also revokes the instruments which determined originating capital debt under section 12E, as unamended, which ceased to be relevant on the commencement of section 54 of the Health Act 1999 on 1st October 1999 (S.S.I. 1999/90).

1978 c. 29; section 12E was inserted by the National Health Service and Community Care Act 1990 (c. 19), section 31, and amended by the Health Act 1999 (c. 8), section 53(1) to (5). The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46).
