Amendment of principal Regulations

2.  In regulation 1(2) of the principal Regulations (interpretation)–

(a)after the definition of “the Act”, there shall be inserted the following:–

  • “adjudicator” means an adjudicator appointed by virtue of Schedule 3 to the 1999 Act(1) and includes–

    (a)

    an adjudicator who acts as a special adjudicator for the purposes of section 8 of the Asylum and Immigration Appeals Act 1993(2); and

    (b)

    an adjudicator who acts as a special adjudicator for the purposes of section 3 of the Asylum and Immigration Act 1996(3);;

(b)after the definition of “the 1995 Act”, there shall be inserted the following:–

“the 1999 Act” means the Immigration and Asylum Act 1999(4);; and

(c)after the definition of “governor”(5), there shall be inserted the following:–

“Immigration Appeal Tribunal” means the Tribunal continued in force by virtue of section 56(1) of the 1999 Act.

By virtue of article 3 of S.I. 2000/168, “adjudicator” and the “Immigration Appeal Tribunal” for the purposes of the Immigration and Asylum Act 1999 (c. 33) are to be treated as the adjudicators and the Immigration Appeal Tribunal for the purposes of the previous Immigration Acts as defined in that article.
