CONTAMINATION OF FOOD

The Scottish Ministers, in exercise of the powers conferred on them by section 1(1) and (2) and section 24(1) of the Food and Environment Protection Act 1985(1), and of all other powers enabling them in that behalf, hereby make the following Order:
1. This Order may be cited as the Food Protection (Emergency Prohibitions) (Amnesic Shellfish Poisoning) (Orkney) Partial Revocation (Scotland) Order 1999 and shall come into force at 1900 hours on 1st September 1999.
2. The Food Protection (Emergency Prohibitions) (Amnesic Shellfish Poisoning) (Orkney) (Scotland) Order 1999(2) is revoked insofar as it designates any part of the area set out in the Schedule to this Order.

The area of sea below high water springs enclosed by a line starting at a point on the East shore of the Orkney Mainland at 59° 00'N 2° 54.4'W; then East to a point at 59° 00'N 2° 30'W; then North to a point at 59° 4.6'N 2° 30'W; then West to Lamb Head on the island of Stronsay at 59° 4.6'N 2° 31.8'W; then West and North along the shore of Stronsay to Links Ness at 59° 09.1'N 2° 40.4'W; then West and South to a point on the South East coast of the island of Eday at 59° 08.6'N 2° 44.4'W; then along the South shore of Eday to War Ness at 59° 08.3'N 2° 47.1'W; then West to Point of Graand on the island of Egilsay at 59° 07.6'N 2° 55.2'W; then West and North to the Point of Avelshay on the island of Rousay at 59° 08.2'N 2° 57.8'W; then West along the South shore of Rousay to a point at 59° 08.2'N 3° 04'W; then South to a point on the Orkney Mainland at Aiker Ness at 59° 07.4'N 3° 04.4'W; then East and South along the shore of the Orkney Mainland to the start point.

This Order partially revokes the Food Protection (Emergency Prohibitions) (Amnesic Shellfish Poisoning) (Orkney) (Scotland) Order 1999 (“the principal Order”) which prohibited—
(a)fishing for or taking scallops within the area designated in the Schedule to that Order (article 4);
(b)movement of such scallops out of that area (article 5); and
(c)landing, using in the preparation of processing for supply of food of, supplying and other specified activities in relation to, such scallops from the designated area (article 6).
The effect of this Order is to remove the prohibitions in respect of scallops from the area of sea described in the Schedule to this Order.
1985 c. 48; section 1(1) and (2) was amended by section 51(2)(a) and (b) of the Food Safety Act 1990 (c. 16); section 1(2) defines “designating authority”; section 1(2) was further amended by the Scotland Act 1998 (Modification of Functions) Order 1999 (S.I.1999/1756); the functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46).
