The Scottish Ministers, in exercise of the powers conferred on them by section 17(2) of the Food Safety Act 1990(1) and of all the powers enabling them in that behalf, hereby make the following Regulations:

Citation, commencement and extent

1.—(1) These Regulations may be cited as the Contaminants in Food Amendment (Scotland) Regulations 1999 and shall come into force on 30th December 1999.

(2) These Regulations apply to Scotland only.

Amendment of the Contaminants in Food Regulations 1997

2.  In regulation 2(1) (interpretation) of the Contaminants in Food Regulations 1997(2), for the definition of “the Commission Regulation” there is substituted the following definition:–

“the Commission Regulation” means Commission Regulation (EC) No. 194/97 setting maximum levels for certain contaminants in foodstuffs(3), as amended by Commission Regulation (EC) No. 1525/98(4), Commission Regulation (EC) No. 864/1999(5) and Commission Regulation (EC) No. 1566/1999(6);.

Explanatory Note

(This note is not part of the Regulations)

These Regulations, which apply to Scotland only, amend the Contaminants in Food Regulations 1997 by bringing up to date the definition of “Commission Regulation (EC) No. 194/97” setting maximum levels for certain contaminants in foodstuffs, so as to cover its further amendment by Commission Regulation (EC) No. 1566/1999 which altered the date by which the maximum aflatoxin limits laid down for nuts, dried fruit and cereals have to be reconsidered by the Standing Committee on Foodstuffs from 1 July 1999 to 1 July 2001.
