This Order is made in exercise of the powers conferred by section 33(2)(f) of the Serious Organised Crime and Police Act 2005(1).

In accordance with section 172(5) of that Act, a draft of this Order has been laid before Parliament and approved by a resolution of each House.

Accordingly, the Secretary of State makes the following Order:

Citation and commencement

1.  This Order may be cited as the Serious Organised Crime and Police Act 2005 (Disclosure of Information by SOCA) Order 2008 and shall come into force on 23rd July 2008.

Disclosure of information by SOCA

2.  The following functions are designated for the purposes of section 33 of the Serious Organised Crime and Police Act 2005, being functions which appear to the Secretary of State to be functions of a public nature—

(a) protecting public health,

(b) the functions of the Financial Services Authority under the Financial Services and Markets Act 2000(2).

EXPLANATORY NOTE

(This note is not part of the Order)

This Order makes provision in relation to disclosures of information by the Serious Organised Crime Agency established under Part 1 of the Serious Organised Crime and Police Act 2005. Article 2 designates the functions (in addition to the functions listed in section 33 of the Act) for the purposes of the exercise of which the Agency may disclose information.
