The Secretary of State for Health makes the following Order in exercise of the powers conferred by sections 16A(1), (2) and (3) and section 126(3) and (4) of, and paragraph 1 of Schedule 5A to, the National Health Service Act 1977[1], and paragraph 29(1) of Schedule 2 to the National Health Service and Community Care Act 1990[2]. The Secretary of State for Health considers it appropriate in the interests of the health service to make this Order, having completed the consultation prescribed under section 16A(5) of the National Health Service Act 1977[3] and paragraph 29(3) of Schedule 2 to the National Health Service and Community Care Act 1990[4]. Citation, commencement and interpretation 1. —(1) This Order may be cited as the Isle of Wight National Health Service Primary Care Trust (Establishment) and Isle of Wight Healthcare National Health Service Trust and Isle of Wight Primary Care Trust (Dissolution) Order 2006 and shall come into force on 1st October 2006. (2) In this Order—
Establishment and operational date The county of Isle of Wight. (This note is not part of the Order) This Order provides for the establishment on 1st October 2006 of a Primary Care Trust for the Isle of Wight, to be called the Isle of Wight National Health Service Primary Care Trust (article 2). It also provides for the dissolution on that date of the Isle of Wight Healthcare National Health Service Trust established on 11th November 1996, and the Isle of Wight Primary Care Trust established on 1st April 2001 (article 4). The Order makes provision at articles 5 and 6 for the Isle of Wight National Health Service Primary Care Trust to complete the accounts and wind up the affairs of the two bodies dissolved by this Order. There is provision for continuity in the exercise of the functions of these bodies at article 7. A full regulatory impact assessment has not been produced for this Order as it has no impact on the costs of business, charities or voluntary bodies.
