EDUCATION, ENGLAND

The Education Act 2002 (Commencement No. 1) (Amendment) Order 2002

  Made 29th July 2002 

In exercise of the powers conferred by section 216(4) of the Education Act 2002[1] the Secretary of State for Education and Skills hereby makes the following Order:

Citation and Interpretation
     1.  - (1) This Order may be cited as the Education Act 2002 (Commencement No. 1) (Amendment) Order 2002.

    (2) In this Order - 

    "the 2002 Act" means the Education Act 2002;

Amendment of Commencement No. 1 Order
     2. The commencement of section 29 of the 2002 Act effected by article 4 of the Commencement No. 1 Order is hereby revoked.

    
3. Section 27 of the 2002 Act shall come into force except in relation to Wales on 2nd September 2002.

    
4. Accordingly article 4 of the Commencement No. 1 Order shall be amended by substituting "27 and 28" for "28 and 29".

EXPLANATORY NOTE

(This note is not part of the Order)


This Order amends the previous commencement order by revoking the incorrect commencement of section 29, and commencing in its place section 27, so that sections 27 and 28 relating to the new power for governing bodies to provide community facilities will both come into force in England on 2nd September 2002.
