BETTING, GAMING AND LOTTERIES

The Betting, Gaming and Lotteries Act 1963 (Schedule 4) (Amendment) Order 2002

  Made 22nd July 2002 
  Coming into force 19th August 2002 

Whereas a draft of this Order has been laid before Parliament in accordance with section 10(1C) of the Betting, Gaming and Lotteries Act 1963[1] and approved by resolution of each House of Parliament;

     Now, therefore, the Secretary of State, in exercise of the powers conferred on her by section 10(1A)[2] of the Betting, Gaming and Lotteries Act 1963, hereby makes the following Order:

     1.  - (1) This Order may be cited as the Betting, Gaming and Lotteries Act 1963 (Schedule 4) (Amendment) Order 2002.

    (2) This Order shall come into force 28 days after the day on which it is made.

    
2.  - (1) Schedule 4 to the Betting, Gaming and Lotteries Act 1963 is amended as follows.

    (2) For paragraph 10[
3] substitute:

        " (10) Refreshments may be provided on the licensed premises except - 

      (a) where those premises are in England and Wales, intoxicating liquor within the meaning of section 201(1) of the Licensing Act 1964; or

      (b) where those premises are in Scotland, alcoholic liquor within the meaning of section 139(1) of the Licensing (Scotland) Act 1976."

    (3) In paragraph 11 - 

    (a) for "Paragraphs 1 and 4" substitute "Paragraph 1", and

    (b) for "10(2) and (3)" substitute "10".

EXPLANATORY NOTE

(This note is not part of the Order)


This Order amends Schedule 4 to the Betting, Gaming and Lotteries Act 1963 to remove the restrictions on the form of refreshments, other than alcohol, which may be sold in a licensed betting office in Great Britain.
