The Companies (Fees) (Amendment) Regulations 2002

The Secretary of State, in exercise of the powers conferred on her by section 708(1) and (2) of the Companies Act 1985[1], and of all other powers enabling her in that behalf, hereby makes the following Regulations:

     1. These Regulations may be cited as the Companies (Fees) (Amendment) Regulations 2002, and shall come into force on 1st April 2002.

    
2. The Schedule to the Companies (Fees) Regulations 1991[2] is amended by:

    (a) substituting, in respect of the entries in the first column below, the sums set out below in relation to those entries for the sums specified in relation to those entries in the second column of the Schedule to those Regulations as follows:

    (i) entry 4 £9.00
    (ii) entry 5 £9.00
    (iii) entry 9(a) £9.00
    (iv) entry 9(b) £12.00
    (v) entry 9(c) £12.00
    (vi) entry 10(a) £9.00
    (vii) entry 10(b) £12.00
    (viii) entry 10(c) £12.00
    (ix) entry 11(a) £12.50
    (x) entry 11(b) £15.50
    (xi) entry 12(b) £9.00 plus £1.00 for each document supplied

EXPLANATORY NOTE

(This note is not part of the Regulations)


These regulations govern the statutory fees for microfiche based information services for companies.



    
1. The Regulations amend the Companies (Fees) Regulations 1991, as amended by the Companies (Fees) (Amendment) Regulations 1992, the Companies (Fees) (Amendment) Regulations 1994, the Companies (Fees) (Amendment) Regulations 1995, the Companies (Fees) (Amendment) Regulations 1996, the Companies (Fees) (Amendments) Regulations 1998 and the Companies (Fees) (Amendment) Regulations 2000, which require the payment of fees in respect of functions performed by the registrar of companies under the Companies Act 1985.

    
2. Regulation 2(a) amends the Companies (Fees) Regulations 1991, as amended, by:

    (1) increasing the fees applicable in respect of the following matters from £6.50 to £9.00

    (a) the inspection of a basic set of microfiche copies (Fee No. 4),

    (b) the inspection of the excluded documents of a company recorded and kept by the registrar of companies in the form of microfiche copy (Fee No. 5),

    (c) the delivery of a basic set of microfiche copies at an office of the registrar (Fee No. 9(a)),

    (d) the delivery of a microfiche copy of the excluded documents of company recorded and kept by the registrar in the form of microfiche copy at the office of the registrar (Fee No. 10(a)),

    (e) the delivery of a paper copy of records kept by the registrar relating to a company delivered at the office of the registrar otherwise than at the time of the microfiche (Fee No. 12(b));

    (2) increasing the fees payable in respect of the following matters from £9.50 to £12.00

    (a) the delivery by post of a basic set of microfiche copies pursuant to an on-line request (Fee No. 9(b)),

    (b) the delivery by post of a basic set of microfiche copies pursuant to a form of request other than an on-line request (Fee No. 9(c )),

    (c) the delivery by post of a microfiche copy of the excluded documents of a company recorded and kept by the registrar in the form of a microfiche copy pursuant to an on-line request (Fee No. 10(b)),

    (d) the delivery by post of the microfiche copy of the excluded documents of a company recorded and kept by the registrar in the form of a microfiche copy pursuant to any form of request other than an on-line request (Fee No. 10(c ));

    (3) increasing the fee payable from £10.00 to £12.50 in respect of the delivery of a microfiche copy of a list of members consisting of more than ten pages at an office of the registrar (Fee No. 11(a)); and

    (4) increasing the fee payable from £13.00 to £15.50 in respect of a delivery by post of a microfiche copy of a list of members consisting of more than ten pages pursuant to any form of request.
