COMPETITION

The Merger Report (Interbrew SA and Bass PLC) (Interim Provision) (Revocation) Order 2002

  Coming into force 28th January 2002 

The Secretary of State in exercise of the powers conferred on her by sections 89(2), (3)(a), (b) and (bb), 90 and 134 of the Fair Trading Act 1973[1] hereby makes the following Order:

Citation and commencement
     1. This Order may be cited as the Merger Report (Interbrew SA and Bass PLC) (Interim Provision) (Revocation) Order 2002 and shall come into force on 28th January 2002.

Revocation
    
2. The Merger Report (Interbrew SA and Bass PLC) (Interim Provision) Order 2001[2] is hereby revoked.

EXPLANATORY NOTE

(This note is not part of the Order)


This Order revokes the Merger Report (Interbrew SA and Bass PLC) (Interim Provision) Order 2001 ("the 2001 Order") which prohibited Interbrew SA, Interbrew UK Limited and any other member of the Interbrew group and Bass Holdings Limited from doing things which might have impeded the operation of a further order which the Secretary of State had under consideration for the purpose of remedying or preventing the adverse effects specified in a report of the Competition Commission on the acquisition by Interbrew SA of the brewing interests of Bass PLC (Cm 5019, obtainable from Her Majesty's Stationery Office).

The Secretary of State has now accepted undertakings given to her by Interbrew SA and other members of the Interbrew group pursuant to section 88(2) of the Fair Trading Act 1973 and the 2001 Order is consequently no longer required.
