The Scotland Act 1998 (Transitory and Transitional Provisions) (Grants to Members and Officeholders and Scottish Parliamentary Pension Scheme) Amendment Order 1999

  Coming into force 26th July 1999 

The Secretary of State, in exercise of the powers conferred on him by sections 112(1) and 129(1) of the Scotland Act 1998[1] and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation, commencement and interpretation
     1.  - (1) This Order may be cited as the Scotland Act 1998 (Transitory and Transitional Provisions) (Grants to Members and Officeholders and Scottish Parliamentary Pension Scheme) Amendment Order 1999 and shall come into force on 26th July 1999.

    (2) In this Order "the Grants to Members and Officeholders Order" means the Scotland Act 1998 (Transitory and Transitional Provisions) (Grants to Members and Officeholders) Order 1999[
2] and "the Scottish Parliamentary Pension Scheme Order" means the Scotland Act 1998 (Transitory and Transitional Provisions) (Scottish Parliamentary Pension Scheme) Order 1999[3].

Amendment of the Grants to Members and Officeholders Order
     2. In article 4(2) of the Grants to Members and Officeholders Order (ill-health retirement grant for members) for the words " article 2" substitute "article 3".

Amendment of the Scottish Parliamentary Pension Scheme Order
    
3.  - (1) The Scottish Parliamentary Pension Scheme Order shall be amended in accordance with the following provisions of this article.

    (2) In paragraph (3)(b) of article J1 (ill-health pensions based on service as a participant) after the words "or (b)" insert the words "or, as the case may be, paragraph (2)(a) or (b)".

    (3) In article P1 (transfers to other pension schemes) -

    (a) in paragraph (4) for the words "paragraph (1)(b)" substitute the words "paragraph (3)(b)"; and

    (b) in paragraph (5) for the words "paragraph (1)(a)" and "paragraph (2)(b)" substitute respectively the words "paragraph (3)(a)" and "paragraph (3)(b)".

    (4) In paragraph 3 of Schedule 1 (Scottish Parliamentary Contributory Pension Fund) for the words "paragraph 3" substitute "paragraph 2".

EXPLANATORY NOTE

This Order amends the Scotland Act 1998 (Transitory and Transitional Provisions) (Grant to Members and Officeholders) Order 1999 (S.I. 1999/1081) and the Scotland Act 1998 (Transitory and Transitional Provisions) (Scottish Parliamentary Pension Scheme) Order 1999 (S.I. 1999/1082), correcting some internal cross-referencing in certain of their provisions.
