LAND REGISTRATION, ENGLAND AND WALES

The Land Registration (District Registries) Order 1997

  Made 17th June 1997 
  Coming into force 1st September 1997 

The Lord Chancellor, in exercise of the powers conferred on him by section 132(1) of the Land Registration Act 1925[1], and with the concurrence of the Treasury, hereby makes the following Order:

Title, commencement and interpretation
     1.  - (1) This Order, which supersedes the Land Registration (District Registries) Order 1995[2], may be cited as the Land Registration (District Registries) Order 1997 and shall come into force on 1st September 1997.

    (2) In this Order, unless the context otherwise requires:

    "district land registry" means a district registry of the Land Registry within the meaning of section 132 of the Land Registration Act 1925;

    "the Schedule" means the Schedule to this Order.

District Land Registries
     2.  - (1) The name of the Durham District Land Registry shall be changed to the Durham (Southfield House) District Land Registry.

    (2) Subject to the change of name effected by paragraph (1), there shall continue to be district land registries bearing the names specified in column 1 in Part I of the Schedule.

    (3) There shall be new district land registries bearing the names specified in column 1 in Part II of the Schedule.

    (4) The district of each district land registry comprises the administrative areas specified opposite its name in column 2 in Part I or, as the case may be, Part II of the Schedule.

EXPLANATORY NOTE

(This note is not part of the Order)


This Order, on 1st September 1997, supersedes the Land Registration (District Registries) Order 1995 and:

    (1) changes the name of the Durham District Land Registry to the Durham (Southfield House) District Land Registry;

    (2) creates two new district land registries called the Durham (Boldon House) District Land Registry and the District Land Registry for Wales/Cofrestrfa Tir Ddosbarthol Cymru respectively;

    (3) transfers responsibility for the registration of titles in Cumbria and Surrey from the Durham (Southfield House) District Land Registry (formerly the Durham District Land Registry) to the new Durham (Boldon House) District Land Registry;

    (4) transfers responsibility for the registration of titles in all counties and county boroughs in Wales from the Swansea District Land Registry/Cofrestrfa Tir Ddosbarthol Abertawe to the new District Land Registry for Wales/Cofrestrfa Tir Ddosbarthol Cymru;

    (5) takes account of the changes made to administrative areas in England by:

         The Buckinghamshire (Borough of Milton Keynes) (Structural Change) Order 1995 (S.I. 1995/1769);

         The East Sussex (Boroughs of Brighton and Hove) (Structural Change) Order 1995 (S.I. 1995/1770);

         The Dorset (Boroughs of Poole and Bournemouth) (Structural Change) Order 1995 (S.I. 1995/1771);

         The Durham (Borough of Darlington) (Structural Change) Order 1995 (S.I. 1995/1772);

         The Derbyshire (City of Derby) (Structural Change) Order 1995 (S.I. 1995/1773);

         The Wiltshire (Borough of Thamesdown) (Structural Change) Order 1995 (S.I. 1995/1774);

         The Hampshire (Cities of Portsmouth and Southampton) (Structural Change) Order 1995 (S.I. 1995/1775);

         a resolution of the Swindon Borough Council (formerly the Thamesdown Borough Council) made on 24 April 1997 under section 74 of the Local Government Act 1972 (c. 70) and article 3 of The Wiltshire (Borough of Thamesdown) (Structural Change) Order 1995 changing the name of the new county of Thamesdown to the county of Swindon,

but otherwise leaves unaltered the districts of the Birkenhead, Coventry, Croydon, Gloucester, Harrow on the Hill, Kingston upon Hull, Leicester, Lytham St. Annes, Nottingham, Peterborough, Plymouth, Portsmouth, Stevenage, Telford, Tunbridge Wells, Weymouth and York District Land Registries.
