The Secretary of State, in exercise of the powers conferred on him by section 24 of the Superannuation Act 1972[1] and of all other powers enabling him in that behalf, and with the consent of the Treasury[2], hereby makes the following Regulations: Citation, commencement and interpretation 1 . - (1) These Regulations may be cited as the Local Government (Amendment of Regulations for Compensation on Reorganisation) (Scotland) Regulations 1997 and shall come into force on 31st March 1997. (2) In these Regulations the "principal Regulations" means each of the following:-
(b) The Local Government (Education Administration) (Compensation for Redundancy or Premature Retirement on Reorganisation) (Scotland) Regulations 1995[4]; and (c) The Local Government (Compensation for Reduction of Remuneration on Reorganisation) (Scotland) Regulations 1995[5].
Amendment of principal Regulations (This note is not part of the Regulations) These Regulations amend each of the three sets of Regulations which provide for payment of compensation to certain staff of local authorities and other bodies affected by local government reorganisation on 1st April 1996. The compensation is payable, on fulfilment of certain conditions, where an eligible person (a) ceases to hold employment with a relevant body by reason of redundancy or in the interests of efficiency or (b) takes up a post with a new authority at a lower annual rate of remuneration or suffers a reduction or further reduction in remuneration, where either event occurs during a specified period as a consequence of reorganisation. In each case, the period specified is 6th April 1995 to 31st March 1997. The effect of these Regulations is to extend the specified period to 30th June 1997.
