LOCAL GOVERNMENT, SCOTLAND

The Local Government (Application of Enactments) (Scotland) (No.2) Order 1995

Made 19th October 1995
Laid before Parliament 24th October 1995
Coming into force 14th November 1995

    The Secretary of State, in exercise of the powers conferred on him by section 181(1) and (2)(b) of the Local Government etc. (Scotland) Act 1994[1] and of all other powers enabling him in that behalf, hereby makes the following Order:
    Citation and commencement
        1.    This Order may be cited as the Local Government (Application of Enactments) (Scotland) (No.2) Order 1995 and shall come into force on 14th November 1995.
    Application of enactments
        2.—(1)  Section 2 of the Public Works Loans Act 1965[2] and section 3(11) of, and Schedule 4 to, the National Loans Act 1968[3] shall, in the period prior to 1st April 1996, apply to new local authorities as they apply to local authorities in Scotland.

        (2)  In paragraph (1) above, "new local authorities" means the councils in respect of which an ordinary election of councillors took place on 6th April 1995 in terms of section 5(2) of the Local Government etc. (Scotland) Act 1994.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order provides that, in the period prior to 1st April 1996, section 2 of the Public Works Loans Act 1965 and section 3(11) of, and Schedule 4 to, the National Loans Act 1968 shall apply to new local authorities in Scotland as they apply to existing Scottish local authorities. The "new local authorities" are the unitary authorities on the Scottish mainland which are due to take over existing local authority functions on 1st April 1996.
