NORTHERN IRELAND

The Northern Ireland (Emergency Provisions) Act 1991 (Codes of Practice) Order 1995

Made 14th July 1995
Laid before Parliament 26th July 1995
Coming into force 1st September 1995

    Whereas—
        (1)  in accordance with paragraph 7(1) of Schedule 5 to the Northern Ireland (Emergency Provisions) Act 1991[1], the Secretary of State made a code of practice[2] in connection with the exercise by authorised investigators of the powers conferred by that Schedule:

        (2)  under paragraph 7(5) of that Schedule the Secretary of State may revise the whole or part of that code and issue a revised code:

        (3)  in accordance with paragraph 7(2) of that Schedule the Secretary of State has prepared and published a draft revised code, has considered representations made to him about it, and has modified it accordingly:

        (4)  in accordance with paragraph 7(3) of that Schedule the Secretary of State has laid a draft of the revised code before both Houses of Parliament: Now, therefore, the Secretary of State, in exercise of the powers conferred on him by paragraphs 7(3) and 7(5) of that Schedule, hereby orders as follows:
        1.    This Order may be cited as the Northern Ireland (Emergency Provisions) Act 1991 (Codes of Practice) Order 1995 and shall come into force on 1st September 1995.
        2.    The revised code of practice laid in draft before Parliament on 12th July 1995 in connection with the exercise by authorised investigators of the powers conferred by Schedule 5 to the Northern Ireland (Emergency Provisions) Act 1991 shall come into operation on 1st September 1995.
        3.    The Northern Ireland (Emergency Provisions) Act 1991 (Codes of Practice) (No. 1) Order 1993[3] is hereby revoked.
        4.    This Order extends to the United Kingdom.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order brings into operation on 1st September 1995 a revised code of practice made under Schedule 5 to the Northern Ireland (Emergency Provisions) Act 1991.
    The revised code concerns the exercise by authorised investigators of the powers conferred by Schedule 5. The changes to the code concern paragraph 2(1A) of Schedule 5, which was inserted by section 83(3) of the Criminal Justice and Public Order Act 1994 and under which an authorised investigator may specify the manner in which information is furnished to him.
    The revised code is published by Her Majesty's Stationery Office; copies may be obtained from HMSO bookshops.
