NATIONAL HEALTH SERVICE, ENGLAND ANDWALES

The Bolton Hospitals National Health ServiceTrust(Transfer of Trust Property) Order 1995

TheSecretary of State for Health, in exercise of the powers conferred on her by section 92(1) of the National Health Service Act 1977^[1] and of all other powers enabling her in that behalf, having regard to the change in the arrangements for the administration of hospitals and other establishments and facilities formerly managed by the Bolton Health Authority resulting from the establishment of the Bolton Hospitals National Health Service Trust^[2], having consulted the Wigan and Bolton Health Authority^[3] and that Trust in accordance with section 92(3) of that Act, hereby makes the following Order

Citation, commencement and interpretation
    1.—(1)  This Order may be cited asthe Bolton Hospitals National Health Service Trust (Transfer of Trust Property) Order 1995 and shall come into force on 16th March1995.

    (2)  In this Order—
"the Authority" means the Wigan andBolton Health Authority;
"the Trust" means the Bolton Hospitals NationalHealth Service Trust;
"the trust property" means the items specifiedin a schedule of trust property preparedby and agreed upon by the Authority and the Trust on 28th November 1994, whichschedule has been signed on behalf of both the Authority and the Trust.

Transfer of trust property
    2.    On 16th March 1995 the trust propertyshall be transferred from the Authority to the Trust.

This Order transfers to the Bolton Hospitals National Health Service Trust on 16th March 1995 trust property formerly held by the Wigan and Bolton Health Authority. Acopy ofthe schedule of trust property to which the Order refers can be obtained from the Departmentof Health, NHS Trust Unit, Room 1W29, Quarry House, Quarry Hill, Leeds LS2 7UE.
