FRIENDLY SOCIETIES

The Friendly Societies Act 1992 (Commencement No. 8) Order 1994

Made 28th September 1994

    The Treasury, in exercise of the powers conferred on them by section 126(2) of the Friendly Societies Act 1992[1] and of all other powers enabling them in that behalf, hereby make the following Order:
    Citation and interpretation
        1.—(1)  This Order may be cited as the Friendly Societies Act 1992 (Commencement No. 8) Order 1994.

        (2)  In this Order—
      "the 1923 Act" means the Industrial Assurance Act 1923[2];

      "the 1979 Order" means the Industrial Assurance (Northern Ireland) Order 1979[3];

      "the 1992 Act" means the Friendly Societies Act 1992;

    Days appointed
        2.—(1)  Section 31 of the 1992 Act shall come into force on 1st November 1994 in relation to the carrying on of any insurance business or non-insurance business by a registered friendly society (other than a registered society to which article 2(2), 2(3) or 2(4) of the Friendly Societies Act 1992 (Commencement No. 6 and Transitional Provisions) Order 1993[4] applies) which does not duly apply to the Commission before 1st November 1994 under section 32 or 33 of the 1992 Act for authorisation to carry on or to continue to carry on any class or part of a class of insurance business or any description of non-insurance business.

        (2)  Section 31 of the 1992 Act shall come into force on 1st April 1995 for all remaining purposes.

        (3)  The following provisions of the 1992 Act shall come into force on 1st November 1994:
       (a) section 120(2), to the extent necessary to bring into force the provisions of Parts I and II of Schedule 22 to the 1992 Act specified in the following sub-paragraphs;
       (b) in Part I of Schedule 22 the repeal of:
         (i) that part of section 2(1) of the 1923 Act which has not already been brought into force[5]; and
         (ii) section 2(2) of the 1923 Act; and
       (c) in Part II of Schedule 22, the repeal of:
         (i) that part of article 4(1) of the 1979 Order which has not already been brought into force[6]; and
         (ii) article 4(3) of the 1979 Order.

EXPLANATORY NOTE

(This note is not part of the Order)
    Article 2 of this Order brings into force section 31 of the Friendly Societies Act 1992 in relation to registered friendly societies conducting insurance business or non-insurance business, other than societies to which that section already applies. Section 31 was brought into force, by articles 2(2), 2(3) and 2(4) of the Friendly Societies Act 1992 (Commencement No. 6 and Transitional Provisions) Order 1993, in relation to societies whose income exceeds £3,000.00 or which are deemed to be authorised under the 1992 Act by section 32(7) of the Act. In relation to those societies which do not apply for authorisation by 1st November 1994, section 31 comes into force on that date. In relation to those societies which do apply for authorisation by 1st November 1994, section 31 comes into force on 1st April 1995.
    Article 2 also brings into force the repeal of the definitions of Industrial Assurance Commissioner in the Industrial Assurance Act 1923 and the Industrial Assurance (Northern Ireland) Order 1979.
