MERCHANT SHIPPING
SAFETY

The Merchant Shipping (Safety Officials and Reporting of Accidents and Dangerous Occurrences) (Amendment) Regulations 1994

Made 28th July 1994
Laid before Parliament 5th August 1994
Coming into force 26th August 1994

    The Secretary of State for Transport, after consulting with the persons referred to in section 22(2) of the Merchant Shipping Act 1979[1], in exercise of powers conferred on him by section 21(1)(a) and (3) and section 22(1)(a) of that Act, and of all other powers enabling him in that behalf, hereby makes the following Regulations:—
        1.    These Regulations may be cited as the Merchant Shipping (Safety Officials and Reporting of Accidents and Dangerous Occurrences) (Amendment) Regulations 1994 and shall come into force on 26th August 1994.
        2.    The Merchant Shipping (Safety Officials and Reporting of Accidents and Dangerous Occurrences) Regulations 1982[2]are hereby further amended as follows:
       (a) in regulation 1(2):
       (i) for the definition of "dangerous occurrence" there shall be substituted: "dangerous occurrence has the meaning given to it in the schedule to the Merchant Shipping (Accident Reporting and Investigation) Regulations 1994[3]"
         (ii) the definition of "major injury" shall be omitted;
       (b) for regulation 5(1)(a) there shall be substituted "every accident resulting in death, or in major or serious injury as defined in the Merchant Shipping ("Accident Reporting and Investigation") Regulations 1994";
       (c) regulations 9, 10 and 11 shall be omitted;
       (d) regulation 12(1)(c) shall be omitted;
       (e) in regulation 12(2) ", and" in sub-paragraph (a), and sub-paragraph (b), shall be omitted; and
       (f) the Schedule shall be omitted.

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations amend the Merchant Shipping (Safety Officials and Reporting of Accidents and Dangerous Occurrences) Regulations 1982, to omit provisions dealing with the reporting of accidents and dangerous occurrences (now provided for in the Merchant Shipping (Accident Reporting and Investigation) Regulations 1994).
