EDUCATION, ENGLAND AND WALES

The Education (Gwynedd Technical College and Coleg Pencraig) (Dissolution) Order 1994

Whereas the Secretary of State for Wales has received a proposal from the Further Education Funding Council for Wales, made in accordance with section 51 of the Further and Higher Education Act 1992^[1], for the dissolution of the further education corporations known as Gwynedd Technical College and Coleg Pencraig under section 16(1)(a) of that Act;

Now, therefore, in exercise of the power conferred on him by section 27 of the Further and Higher Education Act 1992, the Secretary of State for Wales hereby makes the following Order:

    1.    This Order may be cited as the Education (Gwynedd Technical College and Coleg Pencraig) (Dissolution) Order 1994 and shall come into force on 1st August 1994.

    2.    In this Order references to Gwynedd Technical College and Coleg Pencraig are to the further education corporations respectively known by those names.

    3.    On 1st August 1994 Gwynedd Technical College and Coleg Pencraig shall be dissolved and all of their respective property, rights and liabilities shall be transferred to Coleg Menai (being a body corporate established^[2] for purposes which include the provision of educational facilities or services).

    4.    Section 26(2), (3) and (4) of the Further and Higher Education Act 1992 shall apply to any person employed immediately before 1st August 1994 by Gwynedd Technical College or Coleg Pencraig as if the references in that section—
 (a) to a person to whom that section applies were to a person so employed;
 (b) to the operative date were to 1st August 1994;
 (c) to the transferor were to Gwynedd Technical College or Coleg Pencraig (as the case may be); and
 (d) to the corporation were to Coleg Menai.

This Order dissolves the further education corporations established to conduct Gwynedd Technical College and Coleg Pencraig consequent on their merger on 1st August 1994 to form Coleg Menai. It provides that the property, rights and liabilities of the two colleges transfer to Coleg Menai and secures the rights of employees by applying section 26(2) to (4) of the Further and Higher Education Act 1992.
