EDUCATION, ENGLAND AND WALES

The Cleveland Tertiary College (Incorporation) Order 1994

Coming into force 29th June 1994

    Whereas in accordance with section 51(1)(a) and 51(2)(a) of the Further and Higher Education Act 1992[1]("the Act") and regulations 2 and 4 of the Education (Publication of Draft Proposals and Orders) (Further Education Corporations) Regulations 1992[2]("the Regulations") the Further Education Funding Council for England ("the Council") has published a draft of a proposal for the establishment by the Secretary of State of a body corporate under section 16(1) of the Act;
    Whereas in accordance with section 51(1)(a) and 51(2)(b) of the Act and regulation 5 of the Regulations the Council has considered representations about the draft proposal and in accordance with section 51(1)(a) and 51(2)(c) of the Act has sent copies of the draft and representations to the Secretary of State for Education;
    And whereas pursuant to the draft proposal the Council has proposed the establishment of a body corporate by the Secretary of State under section 16(1) of the Act;
    Now, therefore, in exercise of the powers conferred on him by sections 16(1) and 17 of the Act the Secretary of State for Education hereby makes the following Order:
        1.—(1)  This Order may be cited as the Cleveland Tertiary College (Incorporation) Order 1994 and shall come into force on 29th June 1994 ("the Commencement Date").
        2.    On the Commencement date there shall be established a body corporate called "Cleveland Tertiary College" for the purpose of establishing and conducting from the operative date a new educational institution of that name (to be formed by the merger of Cleveland College of Further Education and Sir William Turner's Sixth Form College, Redcar).
        3.    The "operative date" in relation to the further education corporation established by this Order shall be 1st August 1994, and the corporation shall conduct Cleveland Tertiary College from that date.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order establishes a further education corporation under section 16(1) of the Further and Higher Education Act 1992 for the purpose of establishing and conducting Cleveland Tertiary College and appoints 1st August 1994 as the "operative date" for the purposes of Part I of that Act.
