The Oil and Fibre Plant Seeds (Amendment) Regulations 1994

    The Minister of Agriculture, Fisheries and Food, the Secretary of State for Scotland and the Secretary of State for Wales, acting jointly, in exercise of the powers conferred on them by sections 16(1) and (8) and 36 of the Plant Varieties and Seeds Act 1964[1] and of all other powers enabling them in that behalf, after consultation in accordance with the said section 16(1) with representatives of such interests as appear to them to be concerned, hereby make the following Regulations:
    Title and commencement
        1.    These Regulations may be cited as the Oil and Fibre Plant Seeds (Amendment) Regulations 1994 and shall come into force on 1st July 1994.
    Amendment
        2.    Paragraph 8(a) of Part I of Schedule 4 to the Oil and Fibre Plant Seeds Regulations 1993[2] is amended by substituting for the table contained in that sub-paragraph the following table:
    Minimum varietal Purity (percentage by number) Basic Seed Certified Seed or Certified Seed of the First Generation Certified Seed of the Second or Third Generation
    (001) For swede rape and turnip rape of varieties to be used solely for fodder purposes the standards shall be 99.7 per cent for Basic Seed and 99 per cent for Certified Seed. back
    Swede rape and Turnip rape(001)  99.9 99.7
    Soya bean 99.5 99.0 99.0
    Flax and Linseed 99.7 98.0 97.5
    Sunflower and White mustard 99.7 99.0

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations, which come into force on 1st July 1994, amend the Oil and Fibre Plant Seeds Regulations 1993 ("the 1993 Regulations") and implement Council Directive 69/208/EEC (OJ No. L169, 10.7.69, p. 3) as ended by Commission Directive 92/107/EEC (OJ No. L16, 25.1.93, p. 1).
    The Regulations provide for the table contained in paragraph 8(a) of Part I of Schedule 4 to the 1993 Regulations to be replaced by a new table (regulation 2) and thereby increase the standard to be satisfied in respect of the minimum varietal purity of soya bean seeds.
    A Compliance Cost Assessment has been prepared and a copy has been placed in the library of each House of Parliament.
