ROAD TRAFFIC

The Goods Vehicles (Operators' Licences, Qualifications and Fees) (Amendment) Regulations 1994

Coming into force 1st June 1994

    The Secretary of State for Transport, in exercise of the powers conferred by sections 89(1) and 91(1) of the Transport Act 1968[1], and now vested in him[2], and the Department of Transport (Fees) Order 1988[3], and of all other powers enabling him in that behalf, and after consultation with representative organisations in accordance with section 91(8) of that Act, hereby makes the following Regulations:—
        1.    These Regulations may be cited as the Goods Vehicles (Operators' Licences, Qualifications and Fees) (Amendment) Regulations 1994 and shall come into force on 1st June 1994.
        2.—(1)  The Goods Vehicles (Operators' Licences, Qualifications and Fees) Regulations 1984[4] shall be amended as follows.

        (2)  In regulation 35(1A)—
       (a) for the words "1st April 1993" there shall be substituted the words "1st June 1994";
       (b) in sub-paragraph (a) for "£170" there shall be substituted "£185"; and
       (c) in sub-paragraph (b) for "£7" there shall be substituted "£8".

        (3)  In regulation 35(1B)—
       (a) for the words "1st April 1993" there shall be substituted the words "1st June 1994";
       (b) in sub-paragraph (a) for "£7" there shall be substituted "£8"; and
       (c) in sub-paragraph (b) for "£170" there shall be substituted "£185".

        3.    Nothing in regulation 2 of these Regulations affects the fee payable in respect of the grant or variation of a licence before 1st June 1994.

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations further amend the Goods Vehicles (Operators' Licences, Qualifications and Fees) Regulations 1984.
    The fee prescribed in respect of the grant of a goods vehicle operator's licence on or after 1st June 1994 is increased—
      (a) from £170 to £185; and
      (b) from £7 to £8 in respect of each specified vehicle.

    The fee prescribed in respect of a variation of a licence on or after 1st June 1994 is increased—
      (a) from £7 to £8 for each additional vehicle where the variation results in an addition to the highest number of specified vehicles between the grant of the licence and the variation; and
      (b) from £170 to £185 in any case where notice of the application for the variation has to be published under section 68(4) of the Transport Act 1968.
