ROAD TRAFFIC

The Motor Vehicles (EC Type Approval) (Amendment) Regulations 1994

Coming into force 31st March 1994

    The Secretary of State for Transport, being a Minister designated[1] for the purposes of subsection (2) of section 2 of the European Communities Act 1972[2] in relation to the regulation of the type, description, construction or equipment of vehicles, and of components of vehicles, and in particular any vehicle type approval scheme, in exercise of the powers conferred by that section and of all other powers enabling him in that behalf, hereby makes the following Regulations:—
        1.    These Regulations may be cited as the Motor Vehicles (EC Type Approval) (Amendment) Regulations 1994 and shall come into force on 31st March 1994.
        2.    The Motor Vehicles (EC Type Approval) Regulations 1992[3] shall be amended in accordance with the provisions of these Regulations.
        3.    In regulation 2(1) for the definition of "the Directive" there shall be substituted the following definition—
      ""the Directive" means Council Directive 70/156/EEC[4] as amended by Council Directives 87/403/EEC[5] and 92/53/EEC[6] and Commission Directive 93/81/EEC[7];" .
        4.    In regulation 14(3) for the words "for the purposes of this paragraph" there shall be substituted "for the purposes of this regulation".
        5.    In Schedule 1—
       (a) for item 33 there shall be substituted the following item—
        33 78/316/EEC 93/91/EEC* L81, 28.3.78, p.3, L284, 19.11.93, p.25 Identification of controls;
       (b) for item 39 there shall be substituted the following item—
        39 80/1268/EEC 93/116/EEC* L375, 31.12.80, p.36, L329, 30.12.93, p.39 Fuel consumption.

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations amend the Motor Vehicles (EC Type Approval) Regulations 1992 and are made in consequence of Commission Directives 93/81/EEC, 93/91/EEC and 93/116/EEC.
    Commission Directive 93/81/EEC further amends Council Directive 70/156/EEC which relates to the type approval of motor vehicles and trailers.
    Commission Directive 93/91/EEC amends Council Directive 78/316/EEC relating to the interior fittings of motor vehicles (identification of controls, tell-tales and indicators).
    Commission Directive 93/116/EEC further amends Council Directive 80/1268/EEC which will, as a result of the amendment, relate to the carbon dioxide emissions and the fuel consumption of motor vehicles.
    The opportunity has also been taken to correct a minor drafting error.
    Copies of the EEC Directives which are relevant to these Regulations can be obtained from Her Majesty's Stationery Office. The details of the Directives are set out below.
