The Local Government Finance Act 1992 (Recovery of Community Charge) Saving Order 1993

Coming into force 16th August 1993

    The Secretary of State for Social Security in exercise of the powers conferred on him by section 114 of the Local Government Finance Act 1992[1] and of all other powers enabling him in that behalf, hereby makes the following Order:
    Citation and commencement
        1.    This Order which may be cited as the Local Government Finance Act 1992 (Recovery of Community Charge) Saving Order 1993, shall come into force on 16th August 1993.
    Saving
        2.    Notwithstanding the repeal of paragraph 7A of Schedule 2 to the Abolition of Domestic Rates (Scotland) Act 1987[2] and paragraph 6 of Schedule 4 to the Local Government Finance Act 1988[3] by Schedule 14 to the Local Government Finance Act 1992, those provisions shall continue to have effect for the purpose of enabling the Secretary of State to amend the Community Charge (Deductions from Income Support) (Scotland) Regulations 1989[4] and the Community Charge (Deductions from Income Support) (No. 2) Regulations 1990[5] (the operation of which in relation to any day falling before 1st April 1993 is saved by section 118 of the Act of 1992) in so far as they relate to any community charge which fell due before 1st April 1993.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order provides that, notwithstanding the repeal of paragraph 7A of Schedule 2 to the Abolition of Domestic Rates (Scotland) Act 1987 and paragraph 6 of Schedule 4 to the Local Government Finance Act 1988 by Schedule 14 to the Local Government Finance Act 1992, the provisions of those paragraphs, which enable regulations to provide for the recovery of community charges by deductions from income support, shall continue to have effect so as to enable amendments to be made to the Community Charge (Deductions from Income Support) (Scotland) Regulations 1989 and the Community Charge (Deductions from Income Support) (No. 2) Regulations 1990.
