PENSIONS

The Local Government Superannuation (Local Commissioners) Regulations 1993

Made 28th May 1993
Laid before Parliament 7th June 1993
Coming into force 28th June 1993

    The Secretary of State, in exercise of the powers conferred on him by section 7 of the Superannuation Act 1972[1] and of all other powers enabling him in that behalf, after consultation with such associations of local authorities as appeared to him to be concerned, the local authorities with whom consultation appeared to him to be desirable and such representatives of other persons likely to be affected by the Regulations as appeared to him to be appropriate, hereby makes the following Regulations—
    Citation and commencement
        1.    These Regulations may be cited as the Local Government Superannuation (Local Commissioners) Regulations 1993 and shall come into force on 28th June 1993.
    Local Commissioners
        2.    The Local Government Superannuation Regulations 1986[2] shall be amended as follows—
       (a) in regulation B2(1) at the beginning of the Table there shall be inserted the following entry—
        Local Commissioners The Commission for Local Administration of which he is a member
       (b) in regulation C1—
         (i) in paragraph (5) after sub-paragraph (j) there shall be inserted the following
            "or
              (k) is a pensionable employee of the Commission for Local Administration in England," ;

         (ii) after paragraph (6) there shall be inserted the following paragraph—
          "  (6A)  In relation to a pensionable employee of the Commission for Local Administration in Wales, the appropriate superannuation fund is the fund maintained by South Glamorgan County Council." ;
       (c) in Schedule 1 after the definition of "Local Act contributor" there shall be inserted the following definition—
        Local Commissioner The meaning given in section 23(3) of the Local Government Act 1974

       (d) in Part I of Schedule 2 at the beginning of the table there shall be inserted the following entries in column 1

          "The Commission for Local Administration in England.
          The Commission for Local Administration in Wales." .

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations add the Commission for Local Administration in England and the Commission for Local Administration in Wales to the list of bodies in Part I of Schedule 2 to the Local Government Superannuation Regulations 1986 whose employees are pensionable employees for the purposes of the local government superannuation scheme. Employees of the two Commissions are currently treated as pensionable employees for these purposes by virtue of admission agreements entered into under regulation B3 of the 1986 Regulations. The Regulations provide for the Commissioners (other than the Parliamentary Commissioner for Administration) to be treated as employees of the Commissions for the purposes of the Scheme.
