LOCAL GOVERNMENT, ENGLAND AND WALES

The Local Government Act 1988 (Defined Activities) (Specified Period) (Woking Borough Council) Regulations 1993

The Secretary of State, in exercise of the powers conferred on him by sections 8(1) and 15(6) of the Local Government Act 1988^[1], and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation and commencement
    1.    These Regulations may be cited as the Local Government Act 1988 (Defined Activities) (Specified Period) (Woking Borough Council) Regulations 1993 and shall come into force on 30th August 1993.

Variation of period
    2.—(1)  This regulation applies to catering carried out at the Woking Leisure Centre, Woking Park, Kingfield Road, Woking, at any time during the period beginning on 30th August 1993 and ending on 28th July 1996.

    (2)  Part II of Schedule 2 to the Local Government Act 1988 (Defined Activities) (Specified Period) (England) Regulations 1988^[2] shall apply to work to which this regulation applies as if for the period of 4 years specified in column (2) there were substituted a period of 2 years 10 months and 4 weeks.

Under Part I of the Local Government Act 1988 (competition), work falling within certain defined activities may be carried out by local authorities only if certain conditions are fulfilled. Regulation 3 of the Local Government Act 1988 (Defined Activities) (Specified Period) (England) Regulations 1988 requires the period included in the specification of work required to be made available in accordance with section 7(2)(b) of the Local Government Act 1988 to be ascertained by reference to those Regulations.

Under those Regulations the Woking Borough Council may not carry out catering work where the period included in the specification is less than a specified period. In these Regulations a shorter period is substituted for the 4 years which would otherwise be the period applicable in respect of catering work carried out for the Woking Borough Council at Woking Leisure Centre, Woking Park, Kingfield Road, Woking.
