CHILDREN AND YOUNG PERSONS

The Child Minding and Day Care (Registration and Inspection Fees) Regulations 1991

    The Secretary of State for Health in relation to England and Wales and the Secretary of State for Scotland in relation to Scotland in exercise of the powers conferred by sections 71(16) and 104(4) of, and paragraphs 1(3), 6(4) and 7 of Schedule 9 to the Children Act 1989[1], and of all other powers enabling them in that behalf, hereby make the following Regulations:-
    Citation and Commencement
        1.    These Regulations may be cited as the Child Minding and Day Care (Registration and Inspection Fees) Regulations 1991 and shall come into force on 14th October 1991.
    Interpretation
        2.    In these Regulations unless the context otherwise requires-
      "the Act" means the Children Act 1989;

      "the 1948 Act" means the Nurseries and Child-Minders Regulation Act 1948[2]

      "full day care" means day care provided for children under the age of eight for a full working day on premises other than domestic premises;

      "sessional day care" means day care provided for children under the age of eight for less than a full working day on premises other than domestic premises.

    Registration
        3.—(1)  An application under section 71(1)(a) of the Act for registration as a child minder shall be accompanied by a fee of £10.00.

        (2)  An application under section 71(1)(b) for registration as a provider of day care shall be accompanied-
       (a) where the applicant provides or is to provide full day care, by a fee of £100.00;
       (b) where the applicant provides or is to provide sessional day care and does not provide and is not to provide full day care, by a fee of £10.00.

        (3)  Where immediately before the commencement of Part X of the Act either-
       (a) any premises were registered under section 1(1)(a) of the 1948 Act, and a person applies within 12 months of the commencement of Part X to be registered under section 71 of the Act in respect of the provision of day care on those premises, or
       (b) a person was registered under section 1(1)(b) of the 1948 Act (registration of nurseries and childminders) and that person applies under section 71 of the Act within 12 months of the commencement of Part X to be registered as a child minder,
    no fee shall be payable.
    Fee on Annual Inspection
        4.    The following fees are prescribed for the purposes of paragraph 7 of Schedule 9 to the Act (fees for annual inspection)-
       (a) where the person registered under section 71 of the Act is a child minder, the sum of £7.50;
       (b) where the person registered under section 71 of the Act is a provider of full day care, whether or not he is also a provider of sessional day care, the sum of £75.00;
       (c) where the person registered under section 71 of the Act is a provider of sessional day care and is not also a provider of full day care, the sum of £7.50.
    Fee payable for issue of copy certificate
        5.    A fee of £5.00 is prescribed for the purposes of paragraph 6(4) of Schedule 9 to the Act (issue of copy certificate of registration under section 71 of the Act where certificate been lost or destroyed).

EXPLANATORY NOTE

(This note is not part of the regulations)
    These regulations provide for the fees that shall be paid to local authorities in relation to Part X of the Children Act 1989 (child minding and day care for young children).
    Regulation 3 provides for the fees that shall accompany applications under section 71 of the 1989 Act (registration for child minding and day care) for registration as a child minder or provider of day care for children under eight.
    Regulation 4 prescribes the fees that shall be payable in respect of the annual inspection of the premises of registered persons. Regulation 5 prescribes the fee that shall be payable where it is necessary to replace a lost certificate.
