COUNTY COURTS

The Register of County Court Judgments (Amendment) Regulations 1991

Made 25th July 1991
Laid before Parliament 16th August 1991
Coming into force 14th October 1991

    The Lord Chancellor, in exercise of the powers conferred on him by section 73(2) of the County Courts Act 1984[1], hereby makes the following Regulations:
    Citation, commencement and interpretation
        1.—(1)  These Regulations may be cited as the Register of County Court Judgments (Amendment) Regulations 1991 and shall come into force on 14th October 1991.

        (2)  In these Regulations, unless the context otherwise requires, a regulation referred to by number means the regulation so numbered in the Register of County Court Judgments Regulations 1985[2].
        2.    Regulation 1(2) shall be amended by inserting (on a new line), after the words "In these Regulations-", the words-
      ""judgment" includes an order;" .
        3.—(1)  Regulation 4 shall be amended by omitting the words "of not less than £1".

        (2)  Regulation 4 shall be further amended by inserting, after the word "except", the words "a judgment made in family proceedings, an order made under section 112 or 112A of the Act, and".

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations amend the Register of County Court Judgment Regulations 1985 so as to—
      (a) provide a definition of "judgment" (regulation 2),
      (b) remove the restriction on registering a judgment for an amount of money which is less than £1 (regulation 3(1)), and
      (c) to preclude the registration of money judgments made in family proceedings, administration orders and orders restricting enforcement (regulation 3(2)).
