The Dental Auxiliaries (Amendment) Regulations 1991

  Except for the purposes of regulation 2(2) 25th July 1991
  For the purposes of regulation 2(2) 1st December 1991

    Whereas a draft of these Regulations, approved by the Privy Council, has been approved by resolution of each House of Parliament, pursuant to section 45(9) of the Dentists Act 1984[1]:
    Now, therefore, the General Dental Council, in exercise of the powers conferred upon them by sections 45(1), (2), (3) and (7) and 46(1) and (2) of the Dentists Act 1984 and of all other powers enabling them in that behalf, hereby make the following Regulations:—
    Citation and commencement
        1.    These Regulations may be cited as the Dental Auxiliaries (Amendment) Regulations 1991 and shall come into force—
       (a) except for the purposes of regulation 2(2), on the day after the date on which the Regulations are made; and
       (b) for the purposes of regulation 2(2), on 1st December 1991.
    Amendment of the Dental Auxiliaries Regulations 1986
        2.—(1)  The Dental Auxiliaries Regulations 1986[2] shall be amended in accordance with the following paragraphs of this regulation.

        (2)  In regulation 6 (fees prescribed by the General Dental Council) for "£6.00" there shall be substituted "£10.00".

        (3)  In regulation 23 (dental hygienists)—
       (a) in paragraph (1) after the words "of any other kind" there shall be added the words ", except that the scaling of teeth under sub-paragraph (b) above may be carried out by a dental hygienist under local infiltration analgesia administered by the dental hygienist or under any local or regional block analgesia administered by a registered dentist";
       (b) in paragraph (2) after the words "has indicated" there shall be inserted the words "in writing"; and
       (c) in paragraph (3) for the words from "Except" to "dental work" there shall be substituted the words "A dental hygienist shall administer local infiltration analgesia".

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations amend the Dental Auxiliaries Regulations 1986 (S.I. 1986/887) ("the principal Regulations") which make provision for separate rolls to be kept for each class of dental auxiliaries and which specify, inter alia, the kinds of work which dental hygienists may undertake and the conditions under which they may undertake such work.
    Regulation 2(2) of these Regulations increases the fee prescribed by the General Dental Council for retention of a name in a roll from £6.00 to £10.00 (the fees for first enrolment of a name in, and the restoration of a name to, a roll remain unchanged).
    An amendment is made to regulation 23 of the principal Regulations to enable dental hygienists to administer, under the direct personal supervision of a registered dentist, local infiltration analgesia for the purpose of scaling teeth, and to carry out other work (whether or not National Health Service work) without the direct personal supervision of a registered dentist, provided that the dentist has specified in writing the course of treatment to be provided (regulation 2(3)).
