AGRICULTURE

The Farm Diversification Grant (Variation) Scheme 1991

Made 8th January 1991
Laid before Parliment 15th January 1991
Coming into force 16th January 1991

    The Minister of Agriculture, Fisheries and Food, the Secretary of State for Scotland and the Secretary of State for Wales, acting jointly, in exercise of the powers conferred on them by sections 28 and 29 of the Agriculture Act 1970[1], and of all other powers enabling them in that behalf, with the approval of the treasury, hereby make the following Scheme:
    Title, commencement and interpretation
        1.—(1)  This Scheme may be cited as the Farm Diversification Grant (Variation) Scheme 1991 and shall come into force on 16th January 1991.

        (2)  In this Scheme—
      "the principal Scheme" means the Farm Diversification Grant Scheme 1987[2];

      "the appropriate Minister" has the meaning provided by paragraph 2(1) of the principal Scheme.

    Savings
        2.    Paragraph 4(b) of this Scheme shall not apply in relation to a farm diversification plan approved under the principal Scheme before 16th January 1991, or to a request for the variation of such a plan or an application for approval of a farm diversification plan received before 16th January 1991 by he appropriate Minister, and this Scheme shall not affect the operation of the principal Scheme in relation to any such plan, request or application.
        3.    The principal Scheme shall be varied in accordance with the following paragraph of this Scheme.
        4.    In paragraph 2(1) (interpretation)—
       (a) in the definition of "designated maps"—
         (i) in sub-paragraph (a), for the words from "at Great Westminster House" to the end of the sub-paragraph there shall be substituted the following:
            "at Noble House, 17 Smith Square, London SW1P 3JR" ,
         (ii) in sub-paragraph (b), for the words from "at Chesser Crug" to the end of the sub-paragraph there shall be substituted the following:
            "at Trawsgoed, Aberystwyth, Dyfed SY23 4HT" ,
         (iii) in sub-paragraph (c), for the words from "at Chesser House" to the end of the sub-paragraph there shall be substituted the following:
            "at Pentland House, 47 Robb's Loan, Edinburgh EH14 1TW" ;
       (b) for the definition of "provision of accommodation" there shall be substituted the following:
          ""provision of accommodation", in relation to persons, means provision of simple overnight shelter or hostel-style self-catering accommodation in a traditional farm building other than a dwelling-house;" .

EXPLANATORY NOTE

(This note is not part of the Scheme)
    This Scheme further varies the farm Diversification Grant Scheme 1987 by restricting the types of on-farm accommodation which may qualify for grant as part of a farm diversification plan to the provision of simple overnight shelter or hostel-style self-catering accommodation in traditional farm buildings (known as "camping barns" and "bunkhouse barns") (paragraph 4(b)).
    The Scheme also amends the addresses of deposit of the designated maps of less-favoured farming areas (paragraph 4(a)).
