The Plant Health (Great Britain) (Amendment) Order 1990

Laid before Parliament 24th August 1990
Coming into force 14th September 1990

    The Minister of Agriculture, Fisheries and Food in relation to England, the Secretary of State for Scotland in relation to Scotland and the Secretary of State for Wales in relation to Wales, in exercise of the powers conferred by sections 1(2)(b), 2 and 3(1) of the Plant Health Act 1967[1] upon the said Minister and the Secretary of State for Scotland and now, in relation to Wales, vested in the Secretary of State for Wales[2] and of all other powers enabling them in that behalf, hereby make the following Order:
    Title, extent and commencement
        1.    This Order may be cited as the Plant Health (Great Britain) (Amendment) Order 1990, shall apply to Great Britain and shall come into force on 14th September 1990.
    Amendment of the Plant Health (Great Britain) Order 1987
        2.    The Plant Health (Great Britain) Order 1987[3] shall be amended as follows—

        (1)  in Part IA of Schedule 1 Item 13 (Phthorimaea operculella (Zeller)) shall be omitted;

        (2)  In Part IIA of Schedule 1 after Item 10 there shall be inserted the following Item—
            "11.    Phthorimaea operculella (Zeller) — Potato Tuber Moth
      Tubers of Potato (Solanum tuberosumL.)


        (3)  in Part IIC of Schedule 1 after Item 15 there shall be inserted the following Item—
            "16.    Colletotrichum acutatum Simmonds — Strawberry Black Spot
      Plants of Strawberry (Fragaria L.) other than fruit and seeds


        (4)  in Part IIC of Schedule 3 in column 3 of Item 27—
       (a) in paragraph (1) after sub-paragraph (i) there shall be inserted the following sub-paragraph—
          "(iA) Strawberry Black Spot (Colletotrichum acutatum Simmonds);" ;
       (b) in paragraph (5) the following words shall be omitted—
        9 "it shall be free from Strawberry Black Spot (Colletotrichum acutatum Simmonds) and".

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order amends the Plant Health (Great Britain) Order 1987 so as to modify the controls on—
      (a) Potato Tuber Moth (article 2(1) and (2)); and
      (b) strawberry plants carrying or infected with Strawberry Black Spot (article 2(3) and (4)).
