LOCAL GOVERNMENT, ENGLAND AND WALES The Cambridgeshire, Norfolk and Suffolk (County Boundaries) Order 1990
1.(1) This Order may be cited as the Cambridgeshire, Norfolk and Suffolk (County Boundaries) Order 1990. (2) This Order shall come into force on 13th March 1990 for any purpose set out in regulation 4(1) (coming into operation of order) of the Local Government Area Changes Regulations 1976[2]. (3) For all other purposes this Order shall come into force on 1st April 1990.
2. In this Order
3.(1) The part of the County of Cambridgeshire and the district of Fenland which forms the area of the parish of Outwell (Isle) and which is marked A6 on boundary map 3 shall be transferred to
(2) The part of the county of Cambridgeshire, the district of Fenland and the parish of Upwell (Isle) which is marked A7 on boundary map 3 shall be transferred to
(3) The parts of the county of Cambridgeshire, the district of Fenland and the parish of Wisbech which are marked A4 and A5 on boundary map 2 shall be transferred to
4. The parts of the county of Norfolk, the borough of King's Lynn and West Norfolk and the parish of Walsoken which are marked A1, A2 and A3 on boundary maps 1 and 2 shall be transferred to
5. The part of the county of Norfolk, the district of Breckland and the parish of Weeting-with-Broomhill which is marked A8 on boundary map 4 shall be transferred to
6.(1) The parish councillors of the parishes of Outwell and Upwell in office immediately before 1st April 1990 shall cease to hold office on that date. (2) The number of parish councillors for the parish of Outwell shall be increased from 9 to 11. (3) The number of parish councillors for the parish of Upwell shall continue to be 13. (4) Elections of parish councillors for the parishes of Outwell and Upwell shall be held on such day before 1st April 1990 as the returning officer shall appoint, and the councillors elected shall come into office on 1st April 1990 and retire on the fourth day after the ordinary day of election of councillors in 1995.
7. The parish of Outwell (Isle) shall cease to exist and its parish council shall be dissolved. Its residuary successor shall be the council of the parish of Outwell, which shall also have custody of the public books and documents of the abolished parish.
8. Any provisions of a structure plan, an old development plan (within the meaning of paragraph 2 of Schedule 7 to the Town and Country Planning Act 1971[3]) or a local plan made or adopted by a county or district council which apply immediately before 1st April 1990 to an area transferred by this Order shall continue to have effect in relation to that area as if they were part of such a plan made or adopted by the council of the county or district to which that area is transferred.
9. Registration of title to land under the Land Registration Acts 1925 to 1986[4] shall cease to be compulsory on sale in the area transferred by article 5 save insofar as section 154(1) of the Housing Act 1985[5], section 81(9) of, 108 of and Schedule 12 to, or 133(8) of the Housing Act 1988[6] or section 173 of the Local Government and Housing Act 1989[7] applies to any land situated in that area.
