LOCAL GOVERNMENT, SCOTLAND

The Local Authorities (Publicity Account) (Exemption) (Scotland) Amendment Order 1990

    The Secretary of State, having consulted such associations of local authorities as appear to him to be concerned and those local authorities with whom consultation appears to him to be desirable, in exercise of the powers conferred on him by section 5(5) of the Local Government Act 1986[1], and of all other powers enabling him in that behalf, hereby makes the following Order:
    Citation, commencement and extent
        1.—(1)  This Order may be cited as the Local Authorities (Publicity Account) (Exemption) (Scotland) Amendment Order 1990, and shall come into force on 12th March 1990.

        (2)  This Order applies to Scotland.
    Interpretation
        2.    In this Order-
      "the principal Order" means the Local Authorities (Publicity Account) (Exemption) (Scotland) Order 1988[2].

    Amendments to the principal Order
        3.    In article 2 of the principal Order, after the definition of "educational establishment" and "pupil" there shall be inserted the following definition:-
      ""school board" has the meaning given in section 1 of the School Boards (Scotland) Act 1988[3]." .
        4.    In paragraph 11(c) of the Schedule to the principal Order, for the word "school", there shall be substituted the words "school board".

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order amends the Local Authorities (Publicity Account) (Exemption) (Scotland) Order 1988 ("the principal Order") which specifies certain exemptions from the application of section 5(1) of the Local Government Act 1986, in terms of which a local authority is required to keep a separate account of its expenditure on publicity. Paragraph 11(c) of the Schedule to the principal Order made an exemption for publicity in the form of communica tions issued, in the course of the normal management and running of an educational establishment, by the education authority or by a member of a school council or college council to former, current or prospective pupils, or to their parents or guardians.
    The School Boards (Scotland) Act 1988 abolished school councils and set up school boards. This Order, therefore, amends the exemption under the principal Order so that it applies to communications from members of school boards instead of communications from members of school councils.
