WATER SUPPLY, SCOTLAND

The Water Byelaws (Extension) (Scotland) Order 1988

Made 24th February 1988
Coming into force 1st April 1988

    The Secretary of State, in exercise of the powers conferred on him by section 72(4) of the Water (Scotland) Act 1980([1]) and of all other powers enabling him in that behalf, hereby makes the following Order:
        1.    This Order may be cited as the Water Byelaws (Extension) (Scotland) Order 1988 and shall come into force on 1st April 1988.
        2.    Any byelaws made by local water authorities under section 60 of the Water (Scotland) Act 1946([2]) which would, but for this Order, cease to have effect before 31st December 1988 shall remain in force until that date.

EXPLANATORY NOTE

(This note is not part of the Order)
    Section 72(4) of the Water (Scotland) Act 1980 provides that byelaws made under section 70 of that Act (which re-enacted section 60 of the Water (Scotland) Act 1946) shall cease to have effect 10 years after they were made, but permits that period to be extended. In terms of Schedule 9 to the 1980 Act, byelaws made under section 60 of the 1946 Act have effect as if made under section 70 of the 1980 Act. This Order postpones the expiry of byelaws made under section 60, which would otherwise expire, until 31st December 1988.
