Coming into force
The Scottish Ministers make the following Order in exercise of the powers conferred by section 33A(1)and (2)(b) of the Housing (Scotland) Act 19871, and all other powers enabling them to do so.
In accordance with section 33A(3) of that Act, a draft of this instrument has been laid before and approved by resolution of the Scottish Parliament.
Citation, commencement and interpretation1

This Order may be cited as the Homeless Persons (Suspension of Referrals between Local Authorities) (Scotland) Order 2022 and comes into force on the day after the day on which it is made.

In this Order—
“the 1987 Act” means the Housing (Scotland) Act 1987,
“relevant local authority” means a council constituted under section 2(1) of the Local Government etc. (Scotland) Act 19942.
Suspension of referrals2
A relevant local authority may not exercise the power under section 33(1) of the 1987 Act (referral of application to another local authority) in respect of any other relevant local authority.
Transitory Provision3
Article 2 does not apply in relation to an application made to a relevant local authority under section 28(1) of the 1987 Act before this Order comes into force.
