The Social Security (Advocacy Service Standards) (Scotland) Amendment Regulations 2021

Coming into force

The Scottish Ministers make the following Regulations in exercise of the powers conferred on them by section 11(2) and (3) of the Social Security (Scotland) Act 20181 and all other powers enabling them to do so.

In accordance with section 96(2) of that Act, a draft of this instrument has been laid before and approved by resolution of the Scottish Parliament.

Citation and commencement1

These Regulations may be cited as the Social Security (Advocacy Service Standards) (Scotland) Amendment Regulations 2021 and come into force on 9 November 2021.

Amendment of the Social Security (Advocacy Service Standards) (Scotland) Regulations 20202

The Social Security (Advocacy Service Standards) (Scotland) Regulations 20202 are amended in accordance with paragraph (2).

These Regulations amend the Social Security (Advocacy Service Standards) (Scotland) Regulations 2020 (“the 2020 Regulations”) to set revised advocacy service standards for the purpose of section 11 of the Social Security (Scotland) Act 2018 (“the 2018 Act”).

Regulation 2 amends regulation 2 of the 2020 Regulations to update the advocacy service standards, which are set by reference to another document in accordance with section 11(3) of 2018 Act. The revised standards are set in the document entitled “Social Security (Scotland) Act 2018 – Advocacy Service Standards” and it was published by the Scottish Ministers on 9 November 2021.
